Minimum Participants
All Group Activities: Our sessions require a minimum of 2 people. Some flexibility may be required to enable us to group you together with other participants and/or take advantage of the most favourable weather conditions. If a minimum is not met we will try to contact you giving as much notice as possible and offer an alternative.
Payment: Payments must be made in advance via our online booking system over the phone or on the beach via card or cash. The person submitting the booking accepts responsibility for payment for everyone listed in the booking and is responsible for ensuring that all other persons listed in the booking are aware of the terms and conditions.
Surf / Weather conditions: In the rare event that Harlyn Surf School considers conditions to be unsuitable for your activity we will make all efforts to reschedule your lesson. Due to summer time demand there is a slight chance we may not be able to reschedule and in this case a credit voucher will be issued
Course Participation Liability and Other Important Information: When booking and paying for a session/s you are confirming that you and the participants you are booking for can swim at least 25m confidently and are fit to take part in our sessions we offer. On the day of your session we may ask you to fill in an enrolment form and sign a disclaimer, if the participants are under 18yrs a parent or guardian will take responsibility for the participants.
Course Participation Liability and Other Important Information: The activities of Surfing, Stand up Paddleboarding, Kayaking and Coasteering carry a degree of risk both to people and property, even if enjoyed under proper supervision by qualified instructors. All participants must make us aware of any medical conditions, illnesses or allergies they may have and any prescribed medication they are taking. All participants must complete an enrolment form before they will be allowed to take part in any listed activities. Parents or guardians must sign for participants who are under 18 years of age. In certain groups where applicable a group leader/ guardian can sign. i.e. schools a teacher can sign on behalf of the group. Harlyn Surf School does not accept any liability for any loss caused by failure to complete the declaration.
All participants must be able to swim at least 25 metres unless agreed by senior instructors. In no circumstances should participants be under the influence of any alcohol, drugs or medication at the time of the lesson which may adversely affect their physical abilities. All participants must agree to abide to all instructions and decisions that Harlyn Surf School and its instructors make. Participants will have the use of Harlyn Surf School equipment during their lessons. Whereas Harlyn Surf School takes all reasonable measures to ensure the safety and good condition of that equipment, participants are responsible for immediately reporting any damage caused to the equipment or which becomes apparent whilst the equipment is in their possession.
Harlyn Surf School does not seek to limit or exclude any liability for personal injury or loss of life which may occur as a result of its own negligence or that of its employees or sub contractors, however, Harlyn Surf School assumes no liability in respect of any personal injury, loss, damage, consequential loss or third party claims which occur through no fault of its own, its employees, officers or agents. All other liability or conditions implied by law are excluded to the fullest extent possible.
Our ‘Natural Disasters’ policy us as follows; No refunds will be offered if cancellation is due to an unforeseeable natural disaster or ‘act of God’ as quite obviously this is out of our control. Specifically, in no event will we be liable for any loss or damage whatsoever without limitation arising from the contracting of COVID-19 Coronavirus whilst engaging in any of our activities and/or sessions and by agreeing to this you thereby release and discharge us from any claims and liabilities against us due to any COVID-19 Coronavirus circumstance which might occur. We will of course honour your booking going forward and will offer you a unique credit code which will enable you to re-book for any of our sessions in the future and will be valid for 1 year from date of the cancelled session.
Coronavirus: Client Assumption of Risks, Exclusion of Liabilities and Health Declaration
As you’d expect, we take your health and welfare, and that of our instructors and other staff, very seriously. If within 14 days prior to your session you or your party have any symptoms you must inform us right away. This may result in cancellation of your session. Harlyn Surf School and its associated instructors, and other staff will not be liable in any way for any losses, damage or other claims whatsoever arising from the contracting of COVID-19 whilst engaging in any of our activities and/or sessions and/or hiring of our kit
You and/or your party
1 | Acknowledge, understand and accept that it is not possible to mitigate [entirely] against the risk of contraction of COVID-19;
2 | Acknowledge, understand and accept that participation in your session or hire of kit may expose you to a risk of contraction of COVID-19;
3 | Acknowledge, consent and agree for all purposes to the above disclaimer and exclusion of liabilities and related claims and accordingly waive, release and discharge us for all purposes from any (potential) claims and liabilities against us due to any COVID-19 Coronavirus circumstance which might occur by virtue of your participation in your session.
Should you and/or any of your party suspect that you may have contracted and/or been exposed to COVID-19 or begin to display any signs or symptoms suggestive of COVID-19 (however mild) and/or if you are responsible for assisting a person classed in any way as vulnerable for COVID-19 purposes, we respectfully ask you not to book or attend at this time. There will be other opportunities to get you on the water!
When making a booking you and/or your party also declare for all purposes that you acknowledge, understand and confirm as follows (and having noted the above disclaimer):
1 | At the time of booking you and/or your party are not awaiting a test or test result for COVID- 19; If in the near future this arises 14 days prior to your session you must inform us.
2 | You and/or the party at the time of booking are not and have not within the 14 days prior to your session displayed signs or symptoms of the above virus.
3 | You and/or the party you are booking for have not within the 14 days prior to your first session had contact with those displaying signs or symptoms of COVID-19 and/or anyone undertaking self-isolation for COVID-19 14 days prior to your session.
4 | You and/or your party that you are booking for are aware that engagement in this activity may increase your risks of contracting COVID-19;
5 | You and/or your party will adhere to social distancing before, during and after the session;
6 | You and/or your party are aware, should the need arise, that you are responsible for your own self rescue and that should you or your party require assistance your instructor may have to break the 2m social distancing rule.

By Booking and paying for a session you are confirming you have read and understood these terms and conditions. Exceptions to these terms and conditions cannot be made for any reason.
